New York State Legal Context
Decadent Outdoors LLC is a New York-based business with a physical location and an active website through which we offer goods and services to the public. As such, we are subject to the following applicable laws and legal standards:
The Americans with Disabilities Act (ADA), Title III requires that private businesses operating as places of public accommodation provide equal access to individuals with disabilities. The U.S. Department of Justice has confirmed that websites qualify as places of public accommodation under Title III and has consistently required conformance with the Web Content Accessibility Guidelines (WCAG) in enforcement actions and settlement agreements.
The New York State Human Rights Law (Executive Law § 296) independently prohibits discrimination on the basis of disability in places of public accommodation in New York. Unlike federal ADA Title III, the New York State Human Rights Law provides for compensatory damages of up to $100,000, civil penalties, and attorney's fees, enforceable through the New York State Division of Human Rights or through private legal action.
The New York General Business Law § 349, as reinforced by the FAIR Act effective February 17, 2026, prohibits unfair, deceptive, or abusive acts and practices in the conduct of business in New York. An inaccessible website, combined with an inaccurate or misleading accessibility statement, may constitute a deceptive business practice under this law, exposing the business to private lawsuits, actual damages, and enforcement by the New York Attorney General.
New York Senate Bill S3114A, effective June 2024, requires New York State agencies to conform to the most current version of WCAG — presently WCAG 2.2. While this law applies directly to state agencies, it reflects New York's official position on the applicable accessibility standard and signals the direction of future private-sector requirements.
We publish this Accessibility Statement as both a legal best practice and an affirmative commitment to the equal access rights of all our customers and visitors.
1. Our Commitment to Accessibility
Decadent Outdoors LLC is committed to ensuring that our website, decadentoutdoors.com, is accessible to all visitors, including individuals with disabilities. We believe that every person deserves equal access to the information, products, and services we offer, and we are dedicated to providing a website experience that is inclusive, usable, and welcoming to everyone.
Accessibility is not a one-time project — it is an ongoing commitment. We continuously work to improve the accessibility and usability of our Site in accordance with applicable laws, including the Americans with Disabilities Act (ADA) and the New York State Human Rights Law, and in alignment with recognized accessibility standards.
2. Accessibility Standards We Follow
Our goal is to conform to the Web Content Accessibility Guidelines (WCAG) version 2.2, Level AA, published by the World Wide Web Consortium (W3C). WCAG 2.2 Level AA is widely recognized as the benchmark for web accessibility and is the standard referenced by the U.S. Department of Justice in ADA enforcement actions and by New York State in its own accessibility requirements.
The WCAG guidelines are organized around four core principles. Accessible websites should be Perceivable, meaning that information and user interface components must be presentable to users in ways they can perceive. This includes providing text alternatives for non-text content, captions for multimedia, and sufficient color contrast between text and backgrounds.
Accessible websites should also be Operable, meaning that user interface components and navigation must be operable by all users. This includes making all functionality available from a keyboard, providing users enough time to read and use content, and avoiding content that is known to cause seizures or physical discomfort.
They should be Understandable, meaning that information and the operation of the user interface must be clear and predictable. This includes making text readable, helping users avoid and correct mistakes in forms, and ensuring that pages behave in consistent and expected ways.
Finally, accessible websites should be Robust, meaning that content must be interpretable by a wide variety of user agents, including assistive technologies such as screen readers, voice recognition software, and alternative input devices.
3. Measures We Have Taken
To ensure and maintain the accessibility of our website, Decadent Outdoors has taken or is actively pursuing the following measures.
We provide descriptive alternative text for all meaningful images on our Site, including project gallery photographs, product images, and informational graphics, so that users who rely on screen readers can understand the content conveyed by those images.
We use clear, semantic heading structures organized from H1 through H6 to help screen reader users navigate page content efficiently and understand the organization of information on each page.
We work to ensure sufficient color contrast between text and background colors throughout the Site, consistent with the WCAG 2.2 Level AA minimum contrast ratios of 4.5 to 1 for normal text and 3 to 1 for large text.
All interactive elements on our Site — including navigation menus, buttons, forms, and links — are designed to be accessible via keyboard navigation without requiring the use of a mouse, so that users with motor disabilities or those who rely on keyboard-only input can fully use our Site.
We provide visible focus indicators so that keyboard users can clearly identify which element is currently selected as they navigate through the page.
All form fields, including our consultation request forms and contact forms, are labeled with descriptive labels that are programmatically associated with their corresponding input fields, ensuring compatibility with screen readers and other assistive technologies.
We use clear, plain language throughout the Site to make content understandable to the widest possible audience, including individuals with cognitive disabilities.
Our website layout is responsive and designed to function properly across a range of screen sizes, devices, and zoom levels up to 200%, without loss of content or functionality.
We avoid content that flashes more than three times per second, which can trigger seizures in individuals with photosensitive epilepsy.
We provide meaningful link text that describes the purpose of each link, avoiding generic text such as "click here" or "read more" without additional context.
We strive to ensure that any multimedia content, such as project walkthrough videos, includes captions or transcripts to make the content accessible to users who are deaf or hard of hearing.
Our cookie consent banner is designed to be keyboard-navigable and compatible with screen readers, ensuring that users with disabilities can manage their cookie preferences on equal terms with all other visitors.
4. Known Limitations
While we strive for comprehensive accessibility, we acknowledge that some areas of our Site may not yet fully conform to WCAG 2.2 Level AA standards. We are actively working to identify and resolve these issues.
Some content provided by third-party services — such as embedded maps, financing application widgets, review platform integrations, or social media feeds — may not be fully accessible. We do not directly control the accessibility of these external services, but we select third-party partners with accessibility in mind and advocate for improvements where possible.
Some older blog posts, project gallery descriptions, or PDF documents may not yet meet current accessibility standards. We are working to remediate this content on an ongoing basis, prioritizing the most frequently visited pages first.
Interactive elements such as our AI-powered chatbot may present accessibility challenges for some users. We are actively working with our technology providers to improve the accessibility of these features.
