This Privacy Policy is drafted to comply with the laws of the State of New York, including the Stop Hacks and Improve Electronic Data Security Act (SHIELD Act, N.Y. General Business Law §§ 899-aa and 899-bb), the New York General Business Law § 349 (Consumer Protection from Deceptive Acts and Practices), the New York Child Data Protection Act (N.Y. Decadent Outdoors LLC (“Decadent Outdoors,” “we,” “our,” or “us”) is a New York State limited liability company providing premium outdoor living solutions, including motorized pergola systems, retractable motorized screens, outdoor kitchens, three-season rooms, cabanas, and related products and services. We are located at 1058 Ballston Lake Road, Ballston Lake, New York 12019.

This Privacy Policy describes how we collect, use, store, protect, and disclose information obtained through our website at decadentoutdoors.com (the “Site”), as well as through telephone, email, text message, in-person consultations, and any other interactions you may have with Decadent Outdoors.

By accessing or using our Site, contacting us by phone or email, submitting a form, scheduling a consultation, or otherwise providing information to us, you acknowledge that you have read, understood, and agree to the practices described in this Privacy Policy. 5. Data Security (SHIELD Act Compliance)

Pursuant to the New York Stop Hacks and Improve Electronic Data Security Act (SHIELD Act, N.Y. General Business Law §§ 899-aa and 899-bb), Decadent Outdoors maintains a data security program that includes reasonable administrative, technical, and physical safeguards appropriate for the size and complexity of our business, the nature and scope of our activities, and the sensitivity of the personal information we collect.

5.1 Administrative Safeguards

We have designated a responsible individual to coordinate our data security program. We assess internal and external risks to the security, confidentiality, and integrity of personal information. We train and educate relevant personnel on our data security practices and procedures. We evaluate and adjust our security program in light of changes to our business operations or new circumstances affecting the security of personal information.

5.2 Technical Safeguards

We assess risks in our network and software design. We implement measures to detect, prevent, and respond to intrusions and system failures. We regularly test and monitor the effectiveness of key controls, systems, and procedures. Our Site uses SSL/TLS encryption (HTTPS) to protect information transmitted between your browser and our server.

6. Data Retention

We retain your personal information only for as long as is reasonably necessary to fulfill the purposes for which it was collected, to provide our services, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Specific retention periods vary based on the type of information and the purpose of collection:

Customer project records: Retained for a minimum of seven (7) years following the completion of a project, consistent with New York State tax and business record retention requirements.

Consultation inquiry records: Retained for up to three (3) years following the date of the inquiry, after which they are securely deleted if no business relationship was established.

Marketing and communication records: Retained until you opt out or request deletion, whichever occurs first.

Website analytics data: Retained in aggregated, non-personally-identifiable form. Raw analytics data associated with identifiable individuals is retained for no more than twenty-six (26) months.

Financial and payment records: Retained in accordance with New York State tax law and generally accepted accounting principles, typically for a minimum of seven (7) years.

When personal information is no longer needed, we dispose of it using secure methods appropriate to the sensitivity of the information, as required by the SHIELD Act.

Deletion: You may request that we delete your personal information from our active systems, subject to our legal obligations to retain certain records (for example, under New York State tax law or for pending contractual obligations).

Opt-Out of Marketing Communications: You may opt out of receiving marketing emails from us at any time by clicking the “unsubscribe” link in any marketing email, or by contacting us directly. Please note that even if you opt out of marketing communications, we may still send you transactional or service-related messages regarding an active project or inquiry.

10. Children’s Privacy

New York Child Data Protection Act (NYCDPA) Compliance: Our Site and services are designed for and directed to adult homeowners and are not intended for, directed to, or designed to attract individuals under the age of eighteen (18).

Decadent Outdoors does not knowingly collect, use, or disclose personal information from individuals under the age of eighteen (18). Our products and services — motorized pergola systems, retractable screens, outdoor kitchens, and related outdoor living solutions — are purchased by adult homeowners, and our Site content is directed exclusively to an adult audience.

If we become aware that we have inadvertently collected personal information from an individual under the age of eighteen (18), we will take prompt steps to delete that information from our records. If you believe that we have collected information from a minor, please contact us immediately using the information provided in Section 13.

11. New York State Consumer Protection Compliance

15.1 Chatbot and Automated Communications
